Over the age of 21 you are not required to wear a helmet, however if you choose not to wear a helmet two things you should keep in mind, number one, you are required to have $10,000 of med pay insurance, and number two, Florida is a comparative negligent state. If you end up in a motorcycle accident, that fact that you were not wearing a helmet, can be used as evidence against you to reduce the amount of liability of the other party for the fault that you are considered to have for failing to wear a helmet.
